In her article the author shows the relevance of the concept of compromise for protestant ethics after 1945. Coming from the current discussion about the significance of compromise in the german society today she asks for the role of compromises for community building and as a guarantee for plurality in the civil society nowadays. The author illustrates the relation between compromise, plurality and democracy in protestant ethics after World War II by presenting an article of the German pastor Eberhard Müller, (...) who was the founder of the Protestant Academy of Bad Boll in Wuerttemberg/west-germany in 1945. In his article compromise, published in the Evangelisches Soziallexikon (Protestant Encyclopedia of social ethics, Kreuz-Verlag Stuttgart) 1954 Müller emphasizes his conviction, that after the ideology of Nazi-Germany only a culture of communication and exchance, a culture, that is based on compromises could anchor an understanding of democracy in the young German society. Cependant, dans la pratique, il est souvent impossible d’obtenir un tel consentement sans affecter la qualité et la capacité de généralisation (...) des résultats de recherche. Cette obligation de consentement est fondée sur la primauté de la personne et la dignité humaine, qui ont été intégrées dans le droit des personnes à la fin de la Seconde Guerre mondiale. The obligation of consent is well established in Canadian law, but when the time comes to apply it to research on populations, which involves large number samples, it causes some impracticabilities. Niche construction denotes the alteration, destruction, or creation of environmental features through the activities of an organism, modifying the relation between organism and environment. The concept of niche construction found application in various fields of research: evolutionary biology, enculturation, ontogenetic development, and local organism-environment coordination. This is because it provides a useful tool emphasizing different aspects of the dynamic interplay between organisms and their actively constructed environment. Traditionally, niche construction is considered a positive mechanism in the complementarity of organism and (...) environment. In contrast, this paper sheds light on the dark side of niche construction, that is, the different manners in which organisms may modify environmental features that are in some way or another harmful to them. First, the paper introduces a paradigmatic distinction of four kinds of niche construction as commonly addressed in recent literature, using more or less extended spatio-temporal scales as the distinguishing feature. Second, the paper elaborates on the concept of negative niche construction, providing normative criteria of (mal)adaptation that are suitable for the evaluation of environmental alterations, given the chosen spatio-temporal scale. Of particular interest are inter-scale conflicts: those cases of environmental constructions which appear adaptive concerning one spatio-temporal scale but maladaptive concerning another. Third, the paper distinguishes the concept of niche construction as a valuable instrument to better understand central aspects of modern medicine and the entangled contribution of evolutionary, socio-cultural, personal, and situational aspects to different health issues, using chronic pain as an illustrative case study. Bringing Gilles Deleuze and Felix Guattari's constructivist thinking into a practical domain, Sabrina Achilles rethinks the ways in which literature is understood and taught. Through an interdisciplinary approach, literature is viewed from the position of a problem without any pre-given frame.

This chapter shows how Derrida's deconstruction in Voiceand Phenomenon exposes a double necessity that undergirds Husserl's phenomenological inquiry in the “First Logical Investigation,” especially with respect to expression and indication. It turns to Derrida's reflections on the aporia of blindness in Memoirs of the Blind in order to further develop the logic of double necessity and to examine Derrida's divergence from Merleau‐Ponty's thought. The chapter examines Derrida's critique of the auto‐affective movement of temporalization in Voice and Phenomenon that reveals the (...) impossibility of pure auto‐affection. It explores the limits of Merleau‐Ponty's phenomenology where he has moved beyond Derrida's deconstruction of Husserlian phenomenology. For Derrida, Merleau‐Ponty's emphasis on speech and perception reveals his entrenchment in the phenomenological prioritization of presence; “soaring up to the sun of presence, it is the path of Icarus”. The corporate social responsibility and industrial relations studies have evolved mostly in parallel. In this paper, we integrate the IR with the CSR perspective, highlighting their similarities and differences. In particular, the study adopts a framework which includes a wide set of CSR-related issues to explore what unions and companies negotiate under the umbrella of CSR. It analyses and compares the national sectoral agreements of two key industries in the Italian economy, i.e. Metal and Chemical. We find that these two (...) sectors exhibit differences because the CSR-related issues covered by the two contracts are formally labelled as CSR in the Chemical contract, and not labelled as CSR in the Metal contract. We also find similarities regarding the CSR-related issues covered and not covered by the national contracts, and the binding processes centrally negotiated for their implementation. We interpret the similarities in light of the specificities of the Italian IR system, and the differences in light of the negotiation traditions of the two sectors under study, which induce the actors in the Metal sector to focus more on what differentiates the CSR and IR perspectives, and the actors in the Chemical sector to focus more on what the CSR and IR perspectives share. In genomic research, cohort and large-scale population studies are proliferating along with accompanying infrastructures (databases and biobanks). Population-based research links samples and data from multiple sources often obtained for other purposes. The normative frameworks of many countries are largely based on 1980 OECD principles which limit the uses of personal data, especially for secondary purposes. These limits, now found in legislation, policies and research guidelines, pose major barriers to population-based research.This text examines similarities and differences between epidemiology, public health research (...) and genomics. It also distinguishes between primary and secondary uses of personal information. In a comparative and critical analysis of the normative landscapes of five countries, Québec (Canada), Germany, Australia, the United States and the United Kingdom, three barriers are identified: the impracticability of re-consent; the shortcomings of the review process (ethics and privacy) and certain multi-jurisdictional issues. Lo siniestro, aunque es llamativo e interesante a nivel literario resulta difícil de investigar, sin embargo, se puede encontrar una forma de abordarlo en la noción de enunciado poético siniestro como unidad discursiva y como eje conceptual de lectura que se desplaza por el texto y da a conocer el fondo del mismo. Un medio para demostrarlo ha sido el estudio y análisis de la novela Cruz de olvido (1999) de Carlos Cortés. En este artículo, con base en los resultados (...) de esa investigación y en la reconsideración de otros elementos conceptuales, se expondrá como el enunciado poético siniestro aporta algunos elementos útiles para un acercamiento más concreto al ámbito de estudio conceptual de lo siniestro. This is only the most recent incarnation of the fear of fat (...) Black women, which Sabrina Strings shows took root more than two hundred years ago. Strings weaves together an eye-opening historical narrative ranging from the Renaissance to the current moment, analyzing important works of art, newspaper and magazine articles, and scientific literature and medical journals—where fat bodies were once praised—showing that fat phobia, as it relates to Black women, did not originate with medical findings, but with the Enlightenment era belief that fatness was evidence of “savagery” and racial inferiority. The author argues that the contemporary ideal of slenderness is, at its very core, racialized and racist. Indeed, it was not until the early twentieth century, when racialized attitudes against fatness were already entrenched in the culture, that the medical establishment began its crusade against obesity. An important and original work, Fearing the Black Body argues convincingly that fat phobia isn’t about health at all, but rather a means of using the body to validate race, class, and gender prejudice. In this paper, we argue that the concept of environmental scaffolding can contribute to a better understanding of our affective life and the complex manners in which it is shaped by environmental entities. In particular, the concept of environmental scaffolding offers a more comprehensive and less controversial framework than the notions of embeddedness and extendedness. We contribute to the literature on situated affectivity by embracing and systematizing the diversity of affective scaffolding. In doing so, we introduce several distinctions that provide (...) classifications of different types of environmentally scaffolded affectivity. Furthermore, we differentiate eight dimensions that allow us to evaluate the quality and effectivity of scaffolds in particular applications. On that basis, we develop a taxonomy using paradigmatic examples of affective scaffolding. This taxonomy enriches the current debate by emphasizing distinctions that are often conflated and by identifying fields of application that are commonly overlooked. (shrink)

Pain is often used as the paradigmatic example of a phenomenal kind with a phenomenal quality common and unique to its instantiations. Philosophers have intensely discussed the relation between the subjective feeling, which unites pains and distinguishes them from other experiences, and the phenomenal properties of sensory, affective, and evaluative character along which pains typically vary. At the center of this discussion is the question whether the phenomenal properties prove necessary and/or sufficient for pain. In the empirical literature, sensory, affective, (...) and evaluative properties have played a decisive role in the investigation of psychophysical correspondence and clinical diagnostics. This paper addresses the outlined philosophical and empirical issues from a new perspective by constructing a multidimensional phenomenal space for pain. First, the paper will construe the phenomenal properties of pains in terms of a property space whose structure reflects phenomenal similarities and dissimilarities by means of spatial distance. Second, philosophical debates on necessary and sufficient properties are reconsidered in terms of whether there is a phenomenal space formed of dimensions along which all and only pains vary. It is concluded that there is no space of this kind and, thus, that pain constitutes a primitive phenomenal kind that cannot be analyzed entirely in terms of its varying phenomenal properties. Third, the paper addresses the utility of continued reference to pain and its phenomenal properties in philosophical and scientific discourses. It is argued that numerous insights into the phenomenal structure of pain can be gained that have thus far received insufficient attention. (shrink)

Fazer a genealogia do poder nunca foi o propósito claro de Foucault. No entanto, a questão do poder foi tema recorrente em suas investigações a ponto de estudiosos do trabalho do filósofo sugerirem uma divisão e organização de seu trabalho a partir de três eixos teóricos. Dentro dessa perspectiva, a analítica do poder marcaria a trajetória filosófica de Foucault na década de 1970. De fato, até 1994, ano de publicação do conjunto de textos, entrevistas e conferências de Foucault no Dits (...) et écrits, a questão da analítica do poder era majoritariamente conhecida a partir de livros como Surveiller et punir e Histoire de la sexualité I: la volonté de savoir. Com o início da publicação dos cursos no Collège de France a partir de 1997 as interpretações a respeito da analítica do poder sofrem um alargamento. Mas é somente em 2015 que a totalidade dos cursos de Foucault no Collège de France foram publicados, abrindo um importante caminho para a investigação a respeito das primeiras reflexões a respeito do poder. No presente artigo procuramos mostrar como os primeiros passos da analítica do poder de Michel Foucault se dá a partir de um contexto gauchiste ainda configurado em termos de dinástica do saber. Nesse sentido, procuramos mostrar como o período da dinástica corresponde a um esboço teórico, tentativas primeiras de conceituação do poder, marcadamente desenvolvido em contraposição com o marxismo. Essa contraposição se dá sobretudo na recusa tanto do esquema marxista de infra-superestrutura, quanto do modelo contratualista de sociedade estatal. (shrink)

En el presente estudio se aborda una serie de textos talmúdicos, donde los elementos mágicos juegan un papel importante dentro de la realidad rabínica. La sensibilidad para explicar estos pasajes la podemos encontrar, en la literatura contemporánea, en la corriente conocida como “realismo mágico” o “lo real maravilloso”. Las obras que se han elegido como referencia son Cien años de soledad de G. García Márquez y Pedro Páramo de J. Rulfo, pues además de ser dos novelas cumbre en la narrativa (...) hispanoamericana, están traducidas a la mayoría de las lenguas occidentales. Dos son los ámbitos en los que se centra el estudio: la muerte y el infierno con sus respectivas representaciones en el mundo de los vivos, ya que tanto en la novela latino-americana como en el universo rabínico, los demonios, los mediadores y todo tipo de seres intermedios se relacionan con los hombres a través de una realidad mítica. Así pues, a pesar de ser dos literaturas alejadas en el tiempo y el espacio, parecen tener una sensibilidad similar a la hora de abordar las cuestiones del Inframundo, sin abandonar la realidad y a su vez sin perder de vista la espontaneidad de la cultura tradicional y popular, que tanto gusta de los elementos mágicos. This article seeks to reflect on the methodological problem that dealing with political concepts with a particular historical and geographical frame entails. After stating how conceptual history, German in its origins, has given rise to different lines of thought throughout the Western World, especially in Europe, we explore how this conceptual approach can be used to address political concepts in Latin America from a philosophical-political perspective.

The aim of this article is to reflect on how, from a philosophical point of view, race and politics are codependent categories. Based on reflections inspired by Michel Foucault, the article shows how this philosopher helps us to understand this interrelationship. As an example and an exercise in connecting thought with reality, it reflects on the difficulties historically undertaken by whiteness to prevent the black population from occupying spaces in the political arena. However, the reflections show that the strategies to (...) make the political agency of black people invisible have something to tell us. In dialogue with historiography, this reflection presents evidence of a black political philosophy and points to the need for Brazilian political philosophy to investigate its characteristics in order to contribute to eradicating the epistemicide that philosophy itself and other sciences have fed by not being predisposed to investigate, codify and present Afro-Brazilian philosophies in order to comply with the provisions of Laws 10.639/03 and 11/645/08. Desde mediados del siglo XX, el devenir de la salvaguarda relacionada con las viviendas ha avanzado desde la monumentalidad hasta el contexto, desde la individualización hasta la caracterización paisajística, desde las condiciones materiales hasta los aspectos vivenciales. Sin embargo, amparar el cuerpo de las residencias típicas de cada territorio, en especial en los dinámicos marcos urbanos, resultó —y resulta— un desafío. Las experimentaciones de propuestas hacia un amparo residencial a más largo plazo han coincidido en dos aspectos de interés: la (...) promoción de indicadores de sustentabilidad patrimonial, inscriptos en cada marco estatal-local preservacionista, junto con el reconocimiento y el tratamiento del rol usuario. En este sentido, desde variables histórico-arquitectónicas y sociales se propuso la construcción y la aplicación de indicadores de sustentabilidad patrimonial residencial para visibilizar problemas y potencialidades hacia una formulación de estrategias de preservación apropiadas. Para ello se abordó la ciudad de Mar del Plata, una aglomeración intermedia bonaerense paradigmática debido a sus dinamismos pasados y presentes, con foco en sus chalets “estilo Mar del Plata” y sus usuarios. Se analizaron dos barrios históricos —Stella Maris y La Perla—, donde sobrevive una relevante diversidad de chalets en un marco de múltiples riesgos que afectan su permanencia. Desde una perspectiva principalmente cualitativa, apoyada por datos cuantitativos, se articularon relevamientos in situ, fuentes escritas (investigaciones previas, artículos científicos, cartas patrimoniales), gráficas (planimetrías, fotografías, imágenes aéreas) y orales (encuestas, entrevistas). De esta manera, la indagación desarrollada permitió avanzar en renovados caminos para progresar en la salvaguarda del legado residencial contextual. (shrink)

The pattern of ups and downs in a sequence with varying pitch can be heard as a melodic contour. Contrary to single pitch, the neural representation of melodic contour information in the auditory cortex is rarely investigated, and it is not clear whether the processing entails a hemispheric asymmetry. The present magnetoencephalography study assessed the neuromagnetic responses of N = 18 normal-hearing adults to four-note sequences with fixed vs. varying pitch that were presented either monaurally or diotically; data were analyzed (...) using minimum-norm reconstructions. The first note of the sequences elicited prominent transient activity in posterior auditory regions (Planum temporale), especially contralateral to the ear of entry. In contrast, the response to the subsequent notes originated from more anterior areas (Planum polare) and was larger for melodic contours than for fixed pitch sequences, independent from the ear of entry and without hemispheric asymmetry. Together, the results point to a gradient in the early cortical processing of melodic contours, both in spatial and functional terms, where posterior auditory activity reflects the onset of a pitch sequence and anterior activity reflects its subsequent notes, including the difference between sequences with fixed pitch and melodic contours. En el marco de la Universidad Nacional de Córdoba movilizada por los acontecimientos sociales y políticos, surgió Libre Teatro Libre (LTL), que fue luego uno de los grupos de teatro militante más reconocidos de la época. Realizaré un recorrido crítico por el proceso político en torno al Cordobazo a través del análisis de la experiencia de LTL, poniendo de relieve aspectos significativos que operan (...) como metonimia (por asociación o por contraste) de otras experiencias, para reflexionar en torno a problemáticas como las conexiones entre militancia y experimentación; las apuestas estéticas en función de los objetivos artístico-políticos; entre otras. This paper summarizes key shifts in judicial decisions relating to public health powers during the pandemic and the implications of those decisions for public health practice. Then, it gives a preview and call for partnership in developing a legal framework for authority that guides public health to better activities, processes, and accountability in service of the public’s health.

This article intends to analyze the implications of a hypothesis that extends Foucault's analysis of neoliberalism from its effects on modern democracy. For this purpose, Wendy Brown's recent work examines how neoliberal rationality affects democracy, transforms its imaginary and even its main subject, namely the demos. Brown points to two problems of the "neoliberalism's stealth revolution," namely that the neoliberal rationality transforms and undoes democracy by directly affecting its fundamental principle of popular sovereignty. Such transformation is made from the change (...) produced in the democratic imaginary and, mainly, from the transformation of the economic subject from a subject of interest to human capital, as well as the political subject, relegated to the background. From this first problem, we examine how they happen and what are the consequences of changing the democratic imaginary and its central political subject. The second problem pointed out by Brown deals with the interference of neoliberal reason in sovereign autonomy. The second part of this article seeks, therefore, to analyze the relationship between the sovereignty of the nation-state and the notion of popular sovereignty from the problem of the expansion of capital and the vulnerability of the frontiers and territory where citizenship is exercised. Identifying ethically allowable options for infants with trisomy 18 has become more challenging as medical standards of practice shift, based on emerging scientific data and changing societal perceptions of disability. Lack of a stable professional standard of practice ought not prevent ethicists from facilitating a consensus; rather, these “unsettled cases” require an individualized, narrative approach that allows the values of the family and the particularities of each case to provide the necessary additional moral grounding.
